Postory is an AI-powered social media content creation platform that helps you create, manage, and publish content across multiple social media platforms. You can contact us by email at [email protected] These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and VADYM PETRYSHYN, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

By creating an account and using the Postory platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legal agreement between you and VADYM PETRYSHYN. For users in the European Economic Area (EEA): These Terms do not affect your statutory rights as a consumer under applicable EU law, including the right to withdraw from distance contracts within 14 days and protections under consumer protection regulations.

2. Service Description

Postory provides an AI-powered social media content creation platform that includes: • Chat-based AI assistance for content creation • Multi-model post generation (using various AI providers) • Draft management and content organization • Social media integrations for publishing • YouTube video transcription and content extraction Our AI agents provide content suggestions and assist with writing, but the final content is your responsibility. You are solely responsible for any decisions or actions you take based on the content generated by the Service.

3. Eligibility and Account Registration

You must be at least 18 years old to use the Service. By registering, you represent and warrant that: • You are at least 18 years of age • You have the legal capacity to enter into these Terms • You will provide accurate and complete registration information • You will maintain the security of your account credentials • You will notify us immediately of any unauthorized access • You will not share your account with others You are responsible for all activities that occur under your account.

4. AI-Generated Content and Limitation of Liability

While our AI agents are designed to provide helpful content creation assistance, you acknowledge and agree that: (a) AI-generated content may contain inaccuracies, errors, misleading information, or inappropriate material. You must review all generated content before publishing. (b) The Service is a content creation tool only. Postory does not guarantee that generated content is original, accurate, non-infringing, or suitable for any particular purpose. (c) You are solely responsible for all content you publish, share, or distribute using the Service, whether generated by AI or written by you. (d) VADYM PETRYSHYN is not liable for any damages, losses, claims, or consequences arising from your use, publication, or distribution of AI-generated content, including but not limited to: • Copyright or intellectual property infringement claims • Defamation or libel • Misinformation or factual errors • Violations of third-party platform terms of service • Reputational harm • Legal actions from third parties (e) AI-generated content does not represent the views, opinions, or endorsements of Postory or its operators. (f) You agree to indemnify Postory against any claims arising from content you publish that was generated using the Service. For users in the EEA: This limitation of liability does not affect your statutory rights under consumer protection laws or limit liability for damages caused by intent or gross negligence.

5. Content Ownership and Intellectual Property

Ownership of Your Content: You retain ownership of the original content you create using the Service. However, you are solely responsible for ensuring that any content you publish complies with applicable laws, regulations, and third-party platform terms of service. License to Postory: You grant Postory a limited, non-exclusive, worldwide, royalty-free license to process your content solely for the purpose of providing the Service (e.g., sending prompts to AI providers and returning generated results). This license terminates when you delete your account. Postory's Intellectual Property: All platform content and materials, including the software, design, branding, logos, and the Service itself, are the property of VADYM PETRYSHYN or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our platform without express written permission. AI Output: AI-generated content created for you through the Service is yours to use, subject to the limitations and disclaimers in these Terms and any applicable third-party AI provider terms.

6. Third-Party AI and Service Providers

To deliver our services, we use the following third-party providers: AI Model Providers: • Google (Gemini) — AI content generation • OpenAI (GPT models) — AI content generation • Anthropic (Claude) — AI content generation • xAI (Grok) — AI content generation • OpenRouter — API gateway for additional AI models Content & Media Services: • YouTube (Google) — Publicly available video transcript extraction Authentication & Communication: • Google OAuth — Sign-in with Google functionality • SendGrid (Twilio) — Transactional email delivery Infrastructure: • Cloud hosting providers for servers and storage Your content may be transmitted to these providers solely to operate the Service. We select providers that commit to not using API data for training their public models. Each provider operates under its own terms and policies, and Postory is not responsible for how these providers process data beyond what is covered by our agreements with them. We do not sell your personal information to any third party.

7. Social Media Integrations

The Service allows you to connect third-party social media accounts (e.g., Threads, Twitter/X, LinkedIn, Facebook) for content publishing. By connecting your accounts, you: • Authorize Postory to post content on your behalf as directed by you • Confirm you have the authority to connect and use those accounts • Accept responsibility for complying with each platform's terms of service and community guidelines Postory is not endorsed by, sponsored by, or affiliated with Meta, Google, X (Twitter), LinkedIn, or any other third-party platform unless explicitly stated. Platform-Specific Terms: • Meta/Threads: Your use of the Threads publishing feature is subject to Meta's Platform Terms and Threads' Community Guidelines. You must comply with Meta's content policies when publishing via Postory. • X (Twitter): Your use of the X publishing feature is subject to the X Terms of Service and X Rules. You must comply with X's content policies when publishing via Postory. • Google: Postory's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Postory is not responsible for: • Actions taken by third-party platforms (account suspensions, content removal, etc.) • Changes to third-party platform APIs or terms that affect the Service • Content moderation decisions made by third-party platforms • Any consequences arising from content that violates a platform's terms of service

8. Prohibited Uses

You agree not to use the Service to: (a) Generate, publish, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. (b) Create content that infringes on the intellectual property rights of others. (c) Generate spam, misleading content, or content designed to deceive. (d) Impersonate any person or entity or misrepresent your affiliation. (e) Attempt to circumvent any AI safety measures, content filters, or rate limits. (f) Use the Service for any illegal purpose or in violation of applicable laws. (g) Use automated scripts, bots, or scrapers to access the Service beyond normal usage. (h) Reverse engineer, decompile, or attempt to extract the source code of the Service. (i) Generate content that promotes violence, discrimination, or illegal activities. (j) Use the Service to develop competing products or services. We reserve the right to suspend or terminate accounts that violate these prohibitions.

9. Subscription and Payment Terms

Free Tier: Postory may offer a free tier with limited features. Free tier access may be modified or discontinued at any time. Paid Subscriptions: If you purchase a paid subscription: • You agree to pay all applicable fees as described at the time of purchase • Subscriptions renew automatically unless cancelled before the renewal date • Prices are subject to change with 30 days' notice for existing subscribers • All fees are non-refundable except as required by law or as stated in our refund policy For users in the EEA: You have the right to withdraw from a distance contract within 14 days without giving any reason. However, by using the Service immediately after purchase, you acknowledge that you may lose this withdrawal right once the Service has been fully performed. Payment Processing: Payments are processed by third-party payment providers. We do not store your complete payment card information.

10. Account Suspension and Termination

Termination by You: You may terminate your account at any time by following the account deletion process in your settings or by contacting us at [email protected]. Upon termination, your data will be deleted in accordance with our Privacy Policy. Termination by Postory: We reserve the right to suspend or terminate your access to the Service: • For conduct that violates these Terms • For non-payment of fees • If required by law • If continuing your account poses a risk to other users or the Service We will provide reasonable notice before termination except in cases of serious violations or legal requirements. Effect of Termination: Upon termination: • Your right to use the Service ends immediately • We may delete your account data (except as required for legal compliance) • Provisions that should survive termination (indemnification, limitation of liability, dispute resolution) will remain in effect

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that: • The Service will be uninterrupted, error-free, or completely secure • AI-generated content will be accurate, original, complete, or free from errors • The Service will meet your specific requirements or expectations • Any content generated will be suitable for publication on any particular platform • Defects will be corrected in a timely manner Your use of the Service is at your own risk. For users in the EEA: This disclaimer does not affect your statutory rights under consumer protection laws, including rights related to the conformity of digital services.

12. Limitation of Liability

To the maximum extent permitted by applicable law: (a) VADYM PETRYSHYN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill. (b) Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater. (c) These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise). Exceptions: These limitations do not apply to: • Liability that cannot be excluded under applicable law • Damages caused by intent or gross negligence • Death or personal injury caused by our negligence • Fraud or fraudulent misrepresentation For users in the EEA: Nothing in these Terms limits your rights under mandatory consumer protection laws.

14. Governing Law and Dispute Resolution

Governing Law: • For users in the European Economic Area (EEA): These Terms are governed by the laws of Poland, without regard to conflict of law provisions. You also benefit from any mandatory consumer protection provisions of your country of residence. • For users outside the EEA: These Terms are governed by the laws of Poland. Dispute Resolution for EEA Users: If you are a consumer in the EEA, you may bring proceedings in the courts of your country of residence or in Polish courts. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr for alternative dispute resolution. The competent supervisory authority for data protection matters is the President of the Personal Data Protection Office (UODO) in Poland. Dispute Resolution for Non-EEA Users: Any disputes shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts in Kraków, Poland, unless otherwise required by applicable law. Class Action Waiver (US Users Only): To the extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in class actions or collective proceedings.

VADYM PETRYSHYN shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: • Natural disasters, acts of God • War, terrorism, civil unrest • Government actions or regulations • Internet or telecommunications failures • Third-party service provider outages (including AI providers) • Pandemics or public health emergencies • Power outages We will use reasonable efforts to minimize the impact of such events and resume normal service as soon as practicable.

16. Modifications to the Service and Terms

Changes to Service: We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that negatively affect your use of the Service. Changes to Terms: We may modify these Terms at any time. We will notify you of significant changes by: • Posting a notice on our platform • Sending an email to your registered address • Requiring acceptance of new terms upon login For material changes, we will provide at least 30 days' notice. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. In case of any discrepancy between translated versions, the English version shall prevail.
